REGULATIONS REGARDING APPEALS. Regulations governing the making and hearing of appeals by persons whose names are included in the Mili--1 tary Defaulters’ List have been gazet-. [ ted. The Expeditionary Forces Act of last session provided that any man whose name is included in the list shall have the right of appeal to a Magis-' I Irate. If he can show that he die? not evade military service wilfully his name will be removed from the list, and he will cease to be subject to loss of civil rights. Every appeal is to be made in tbb form prescribed by the regulation, and: is to be sent by registered! post to he Minister of Defence, in Wellington, within three months after the publication of the Gazette containing the list, 'the Minister will refer the appeal to a Magistrate, who will have jurisdiction to deal with it. The Minister of Defence will be the respondent in every appeal, and will he entitled to bo heard by any solicitor or by any officer of the Defence Forces. The appellant will be entitled to be heard personally or by any solicitor.
On any appeal the Magistrate may receive such evidence as he thinks fit, whether legally admissible in other proceedings or not. Any* notice in the matter of an appeal may be given to the appellant either personally, or by posting il to the address for service in the notice of appeal. If an appellant makes default in appearing at the hearing of the appeal, the Magistrate may either adjourn the hearing or dismiss the appeal.
