CHARGE OF MANSLAUGHTER.
TRAMWAY WORKER'S DEATH

AUCKLAND, August 19. As a sequel to the death of John Patton, a. tramway worker who was -nocked down by a motor car in Khvher J ass on August 12th, S. Carey and'Ruoart J. Morris, drivers of the two aira nvolved, were charged' at the Police "ourt to-day with manslaughter. Seregant Mathews gave evidence that :nv the way. to thei Morgue, Carey said, The worst of it was, I w.is on my wrong side. There was an obstruction n the other side, and I could not get ■vhrough." Witness : measured the space between an obstruction thrown up by he tramway gang and the kerbing, and •ourid it was 9£- feet. It was 80 yards Tom the spofc where the bloodstains to where it was alleged that Carey hadf turned his car. The accused said,he had passed the obstruction at 9 >'clock ' that morning, just missing «* •nan who was crossing the track. Carey denied that he was travelling at 30 niiles an hour. Morris stated; that he ••vent on the wrong side of the road because there was a cart on. the other 'ide. He did not know there was- a car following. Other witnesses stated that they saw
he two cars travelling at a high speed in one instance abreast and im the other on the wrong side. One witness said the first car missed the deceased by ibout. a foot. - Both accused pleaded. not guilty, and reserved their defence. They were committed for trial.
