The case of Frederick William Harris Daw, manager of the Taitapu Estates Company, which was adjourned to iliable further evidence to be called, was then taken. .

Mr Hay-es appeared for the appellant. James ~E. Prouse, flaxmiller, sawmiller, and farmer, of Mangarakau, in evidence, said that there were eleven settlers on the estate, and no work of any extent had been done by r the company since 1908. Appellant, in evidence, gave details of the land sold and leased ii. T the company' during the past two ye;ur sr.d negotiations that were ?.!;ce ii regard to mining operations and sale of the property. To Captain Pilkington : It would be impossible for anybody to acij-sve kiio-v ledfre of the estate in twelve moutiis. The chairman said that much cf the evidence was wide of the mark. The question was whether Mr Daw was essential in carrying on the estate, and whether anybody could be obtained to fill his position.

Mi- Hayes submitted that the operations of the company must be import-ant for them to send a man out to NewZealand at a high salary to look after their affairs.

The chairman said the company had known for a year that Mr Daw was in the First Division and liable to be called up. The chairman said that under the conditions of the war they were taking farmers . from their farms and making men w-ork shorthanded, while so far as appellant was concerned his work was producing nofching, and the board did not think it would be doing justice to the farmers to send them and leave men who were in appellant' 6 position behind. There was not immediate prospect of extensive settlement, but if there were negotiations for the purchase of the estate no doubt these could be facilitated. The appeal would be dismissed and appellant allowed till the January draft.
