UNDUE INFLUENCE ALLEGED ECHO OF THE WARATAH DISASTER. (Paicas Association.- -'"op^right.) (Received Feb. 19. 11.50 a.n:.) LONDON. Feb % 18. In the Probate Court Hayden Erskine Starke claimed a revocation of the codicil of the will of Miss Mario Mattingley. of Kensington, bequeathing 'J37500 to Dr. Frederick Bryan (an Australian who was Miss Mattingley's grandnephew). and also £7500 to Mrs Starke, who was a passenger on the. Waratah. Plaintiff alleges that Bryan unduly influenced the weak-minded testatrix,, whose relations are chiefly in Australia. She di«l the day the Waratah was supposed to have foundered. The codicil also left the residue of £IO.OOO equally between Dr. Bryan and Airs Starke on condition that if either predeceased the testatrix the whole, of the residue was to go to the survivor.
