I A curious phase of municipal office is likely to be displayed at Ihe meeting of tho Nelson City Council this evening. Cr Gray resigned his seat the other day, and the election of bis successor is now pending, tbe nominations being* in and the date duly fixed. By the Municipal Corporations Act a Council resigning in a body holds office till its successor is elected, or any Councillors whose term expires by effluxion hold office till the election of their successors. But, though the Act is not quite clear on the point, it is fair to assume that an individual Councillor cease? to be such the moment his resigna'ion is handed in and accepted. P s there i3no especial need for the matter to^be tested, arising as it does so seldom Ci Gray would be acting in the best taste if he abstained from voting this evening in any crucial [division, especially as he is about to depart from the city shoitly. By the spirit, and perhaps even by tbe letter of the Act, he ceased to be a Councillor when his resignation was accepted. J And he must realiso that it wonld bo very unfortunate if on the eve of severing his connection with the city be left a legacy of discussion and perplexity to obscure important issues that may arise in the near future after he has gone away.
