This Day. Before J. Shabp, Esq.., R.M. Robert K Turner was charged by Police- Sergeant Nash with beating and kicking his wife Mary Turner. Prisoner was remanded until Monday next, in order to obtain the evidence of his wife and Dr Cotterell. _ I Francois Petit v. Salvario Vernazani. — This was an action to recover £5 amount of wages due for a month. Mr Pitt appeared for the plaintiff and Mr Kingdon for defendant. The Rev. A. M. Garin was sworn as interpreter. Francois Petit sworn: I shipped on board the schooner Glengarry, on 21st December last as carpenter at £5 per month. An agreement to that effect was signed in the captain's book. I left on 9th of January at Havelock, because my hand was bad, and I was obliged to go to the hospital. I asked the captain to get me some ointment from Havelock which he ueglected to do. I have received no wages. Salvario Vernazani sworn: I am master of the Glengarry. I shipped plaintiff as carpenter on 21st December. We went from hero to Mahakipawa where plaintiff was laid up with a bad hand. I went to Havelock but plaintiff never asked me to get him any ointmeut. He gave me no notice of his intention to leave. Owing to his leaving me I was detained at Mahakipawa for 1 2 days and had eventually to pay £10 per mouth to a man to take his place. Judgment for plaintiff for amount claimed with £1 14s. costs. James t. Drane. . This case, in which plaintiff claimed £6 on the grounds of a breach of contract, was heard on 27th January last, and judgment was deferred in order to give the bench time to consider its decision. His Worship stated that although there was no written agreement, he was of opinion that a contract had been entered into by the defendant and that the plaintiff had sustained a certain amount of inconvenience and loss. He should therefore give a verdict- for the plaintiff for £1 and costs £2 14s, and he trusted that this would prove a warning for the future to parties entering into contracts always to have their agreements in writing.
