RESIDENT MAGISTRATES COURT.

[Before J. Poynter, Esq., R.M.] This Day. Weedon v. Reynolds. Claim £2 lOs. balance of contract for carrying defendant and daughter to the port from 16th December till 16th June, at rate of Ids. per month. For the defence it was urged that the contract ceased on May lOth, that the sum of 19s. Gd had been paid, which plaintiff had not accounted for, and that a deduction was to be made, while the bus was laid up for repairs. Judgment was given for plaintiff for 10s , the amount defendant admitted to be due. Hooper & Co. v. W. F. Little. Claim £-1 2s. 6d., for ale and casks. Judgment by default for plaintiff for amount. The magistrate said he had received a letter of expostulation from defendant, who had attended on a former occasion, when plaintiff forgot to attend. He was entitled to his cosis if he applied for them.' Thornton- v. Brooks. —Claim £1 135., goods sold aud delivered. Judgment ior plaintiff, by default.

F. J. Kingston v. Lockhart & Co. — Claim for 116 dozen eggs, delivered on the 6th instant, to defendant's order, or to Patrick Campbell, his clerk, who> asked for an invoice, and promised payment, which was disputed by defendant on the ground ofthe price being too high. The defence was, that defendant did not order the eggs, and that the price, Is. 4d. per dozen, was exorbitant. The goods having been ordered by a clerk, packed, and received, the Magistrate intimated that defendant was responsible for payment,. Plaintiff admitted having offered the same eggs, the day before, for ls. 2d., and Mr. De Carle was called to prove that the price of eggs, on the 6th September, was Is. per dozen. I4d. per dozen,, including packing, would be a fair charge. The newspapers were produced, which stated the price at is. 4d , but defendant produced a receipt from Mrs. Jones, who bought eggs the same time at ls. 2d. The Magistrate said he should take off Id. per dozen for packing, and give judgment for plaintiff for the balance, which was £7 lis.
