This Day. [Before J. Poynter, Esq., R.M.] DRUNKENNESS. John M'Laren was fined 10s. and costs, for being in a drunken and incapable state in the public streets. Civil Cases. Merrington v. W. R. Cator. — Claim £20, goods sold and delivered. Judgment for plaintiff. Askew v. W. J. Hinds.— Claim £4 4s, goods sold and delivered. Judgment for plaintiff. John Carter v. Joseph Cock. Manager of the Dun Mountain Railway. — The claim was £6 10s., for damages to a car, caused by the rotten state of the woodwork of the line. The plaintiff stated — On the 2nd instant, as I was passing Hardy and Collingwood streets, the horse got his foot jammed between the timber anl the iron rail. The woodwork was all rotten. The horse went on one side, and broke both shafts of my car. I went to the manager, the defendant, and told him of the bad state of the tramway. He said he would repair the woodwork, and did so. I took the car to Mr. Balme, who repaired it, and charged me £5. I produce the receipt. I lost three days in consequence, for which' I charge £1 lOs. To Mr. Kingdon: The woodwork was apparently rotten in the road. The horse hitched his shoe | between the wood and iron, and brought up a piece | of wood about two feet long. The woodwork was rotten for about 10 yards, to tlie width of 6 inches. If the wood had been -sound, the horse could not have got his feet between the wood and the iron. It was a bran new car. Mr. Kingdon, for the defence, said it was a misfortune, but he considered the charge excessive, and he knew'thatthe company kept the tramway in as good a state of repair as they could: ; -* The Magistrate gave judgment for plaintiff for £5, not considering hiui .entitled to charge for loss of time.
