RESIDENT MAGISTRATE'S COURT. [Before J. Poyntek, Esq.., R. M.] This Day. civil cases. Buxton & Thornton v. Lines. —Claim of 7s. for horse hire, in M'Conkey and Birrell's estate. Judgment for plaintiff, by default. T. Field v. H. Shuttleworth.—Mr. Sinclair for plaintiff, Mr. Pitt for defendant. This was a claim of £5 10s. for beer supplied to the defendant at Taranaki, and a number of empty casks not returned according to agreement. The whole amount sued for was £16. The defence was that the beer sued for had not been delivered, the beer having run out of the cask on board the ship, and that the plaintiff, if entitled to recover at all, should have brought an action against the company who carried the goods. It appeared that the plaintiff had written several letters to the defendant, in which it was alleged, he had prejudiced his claim. Plaintiff admitted the ale was shipped at the ship's risk, and that he should have sued tho company if defendant had not taken the case out of his hands. The magistrate gave judgment for plaintiff for £10 10s., the value of the casks. Dupuis v. Laughorne. —Claim £6 2s. The debt was admitted, and six weeks allowed to pay it in. Peat and Thornton v. T. Batchelor. —Claim £2 3s. 7d., for goods supplied. Judgment by default for plaintiff. Barrett and Edwards v. McDonald. —Claim £8 165., of which £4 3s. Bd. was admitted and paid into court. The case was adjourned till Saturday, to enable defendant to prepare a set-off, which he claimed. Education Rate. —The following persons were summoned for non-payment of the education rate : —William Hargreaves, Henry Hargreaves, J. Westrop, Edwin Snow, FranI cis Blincoe, jnn., and Thomas Batehelor. ' The amouut in each case was 205., for which judgment was giveu by the court.
