Maintenance Cut After Woman's Divorce
(P.A.) WELLINGTON. This Day. The Court of Appeal has commenced j the hearing of argument in an appeal j which was before it at the March sessions, and which is now before it on re-argument. The appeal is brought by Peggy Armstrong Coutts, of Wellington, against a Supreme Court decision given in October, 1946, which reduced the amount of maintenance payable to her by her former husband. Douglas Evelyn Coutts, of Auckland, soldier. Maintenance was payable under an agreement for separation entered into by the parties three years before their divorce. It is contended by counsel for appellant that the effect of the decision is that a woman who obtained a fixed amount of maintenance under an agreement for separation may not rely on this arrangement being permanent or surviving divorce proceedings. This matter being of considerable legal importance, argument is expected to last two days.
