Whangarei Electricity Supply Appeal

The hearing of the appeals in the case of Wilsons (New Zealand) Portland Cement, Ltd., v. the AttorneyGeneral, was continued in the Court of Appeal yesterday. Mr A. K. North, for the AttorneyGeneral, stated that the appeal of the Attoi’ney-General on behalf of the North Auckland Electric Power Board was against the manner of exercise by Mr Justice Fair of his discretion to control the terms of the injunction. Mr North submitted that the injunction should have been granted, so as to prohibit absolutely the transmission of steam-generated power. Such transmission was illegal, because the Legislature had taken, for the benefit of the public, control of the sale and transmission of electric power, and in granting licenses it restricted transmission to that type of electricity normally conveyed in connection with the particular system mentioned in the license.
In the appellant company's case, the restriction was to hydro-generated electricity, and the transmission of any other electricity was a breach of the public’s rights. Tire case will be continued to-day.
