Fined For Injuring Cow
Negligent, driving ui' a motor vehicle, as a result of which a cow had received a broken leg. was the basis of .a charge brought in the Magistrate’s Court this morning against Alwyn Athol Doel. Angus Ferguson, farmer, of Kiripaka, said he had been driving his cows on the road just inside the borough boundary when :\ car had approached at a “terrific" speed, knocking into one cow and carrying it two chains along the road. Six cows were being driven at the time. Defendant stated that it was dark and raining heavily when the accident occurred. He had been travelling at about 25 m.p.h. and had slowed up when he saw the cows, the last of which had shot across the road in front of him. He could not have avoided striking it. Mr A. E. Harrison, for the defence, submitted that the cow crossing the road suddenly did not amount to negligence on defendant's part. “Although the car got off lightly, the fact remains that the cow’s leg was broken, and there must have been some impact to do that,” declared the Magistrate. Mr G, N. Morris. “T think a motorist, when passing cows, should be going at such a speed that he can stop dead. Most of them do this."
