The death occurred, at the Dunedin. Hospital yesterday morning of Con—itablo James: Butler, who was the victim of an assault by a drunken prisoner at the Central Police Station on Christmas Day. An inquest was opened at the hospital early in the afternoon, and, after evidence of identification, was adjourned sine die, John Edward McElroy was charged in the Police Court last Tuesday with assaulting Constable Butler in the execution of his duty, with drunkenness, and with damaging a cell utensil. On the last tv/o charges, McElroy was found guilty and fined, but the Bench did not feel inclined to deal

with the assault charge until the ex?nt of • Constable Butler’s injuries wore ascertained. He was, therefore, remanded until January 5.
