Convicted Although He Did Not Drive Car

An interesting point arose at the recent sitting of the Rav/cne Police Court when Moka Smith, a native bushman, was charged with being intoxicated when in charge of a motor vehicle. For accused, Mr H. F. Guy said that Smith, realising that he was unfit to crive a car, had given the wheel to his brother, and was actually only a passenger.

■ The police contention that Smith was in the same capacity as the owner of a car driven by a chauffeur was upheld by the Bench, and Smith was convicted and discharged.
