JUDGE DISMISSES CLAIM

[Per Press Association.— Copyright.! WELLINGTON. This Day. Without calling on the defence to give evidence, Mr Justice Smith, after a five days’ hearing in the Supreme Court at Wellington, yesterday entered a non suit, with costs approximating £6OO, against Norman Heaton Pike, of Auckland, in his claim against David James Richards, of Wellington, retired professor, and Roy Nathaniel Barton, of Featherston, sheep farmer, respectively third and second mortgagees of a Wairarapa property named “Bank View,” which Pike owned subject to mortgage. Against both defendants as mortgagees in possession Pike claimed £4OO0 J for alleged neglect, £1250 as occupational • rent, and an order for accounts. Against Richards alone he sought £B2O as damages for alleged forced sale of stock, an order declaring null and void an agreement of June 4, 1935, transferring his interest in “Bank View” to Richards,, and an order for the delivery or cancellation of transfer of property.
