WAGES CONTRACT APPEAL

[Per Press Association. — Copyright. 3 WELLINGTON, This Day.

On March 30 J. Ballantyne and Go., of Christchurch, applied to the Court of Appeal for an' interpretation of a contract made by the company’s agent in London, whereby Chas. Francis Martin de Bueger was engaged by the company as a tailor and cutter for three years at a remuneration of £7OO sterling a year. Yesterday judgment was given by a majority of the Court, Justices Ostler, Blair and Kennedy, allowing the appeal with costs. The majority of the Court held that the payment of £7OO per annum in New Zealand currency made by the company was a full discharge of the salary agred to be paid under the contract.

In dissenting in the judgment, the Acting-Chief Justice, Mr Justice Reed, considered the question involved was purely one of construction, and, in his view, should be dismissed. Judgment was entered in accordance with ’ the majority view with costs.
