LYSNAR V. NATIONAL BANK

ECHO OF PRIVY COUNCIL CASE. ti-Vr Press Association. —c coynahl . 1 GISBORNE, This Day. A further echo of a long standing action between William Douglas Lysnar and the National Bank of New Zealand concerning the Arowhana station, regarding which Mr Lysnar was eventually successful on an appeal to the Privy Council, came before Mr Justice Reed at the Supreme Court yesterday. • Arising out of the Privy Council judgment, three cases—two being claims for damages and the other claim for possession—had been set set down for hearing. As against this the bank had filed a motion for the stay of execution to the Privy Council’s judgment. Mr Lysnar, appearing in person today, asked the Judge to deal immediately with the bank’s motion. The Judge said the course was not possible, as the matter was being dealt with by Mr Justice Blair. Mr Lysnar contended that he was entitled to have the matter dealt with as soon as possible. His Honour said he considered that there would be no great hardship in a short postponement, in order that the matter should be- dealt with by the judge cognisant with the facts. The three cases and the motion for a stay of execution were adjourned to Wellington, where they will be dealt with by Mr Justice Blair at a special sitting of the Supreme Court on September 2.
