OWNERSHIP OF HORSE
ACTION IN COURT. .TUDGMENT FOR 'TRAINER. (Per Press Association.—Copyright.) WELLINGTON, Tins Day. A dispute regarding' the ownership cf the racehorse Colossical came before -\ir E. Page, S.M., in the .Magistrate's Court yesterday, when P. A. Finlay, trainer, of Wellington, sued H. 0. Snell and W. Thompson for damages as the result of an alleged breach of contract, in connection with their transfer of interest in the horse. Buell and Thompson, in a, cross action, asked for an order for the possession of the horse, or, alternatively £IOO damages. After hearing the evidence the Magistrate said, it seems that 'defendants 1 letter of withdrawal from partnership in the ownership of the horse was a clear repudiation of the bargain. He proposed to assess damages for the enforced idleness of the horse from NovI ember Id until March 10, as a result of the. dispute over ownership. He fixed 1 damages at £12.1, and said if there was any furl,her diflicully he would reserve Hie question for reviewing Ihe damages * o>i application for a rehearing. Leave to appeal was (ixed at the ' amount of Judgmoni, plus :IMO 10/-. 'the 1 cross-action by Snell and Thompson 1 Was dismissed. *
