MAGISTRATE’S DECISION. A NOVEL POINT. Reserved Judgment in the civil action iu which Arthur William Dent (Mr D. L. Ross) sought to recover from Lionel P. Ford, Hading as Whangarei Bakeries, Ltd. (Mr R. K. Trimmer) the sum of 197 7/S, as the ditference between the actual amount plaintiff received and the amount he alleged he was entitled to receive as wages under the award, was delivered in the Magistrate’s Court by Air G. N. Morris, S.M., yesterday afternoon. The case was heard on December 12. Air Ross, for plaintiff, then said that when Ford was trading as a baker at Pnkekohe lie was cited to the award, and claimed that Whangarci Bakeries. Ltd., of which defendant was managing director, should also bo bound by the award, and that he should have paid Dent the wages stipulated iu the award. If defendant was not bound by the new award of December, 1931, counsel claimed that lie was by the old one. For the defence, Mr Trimmer said it, would be a new departure for the Court to hold that notice given to a shareholder should bind the company.
In delivering judgment, Air Morris said Ford had been personally served, but held that the company was a separate entity, and that Ford would have to be served as managing director of the company before it could bo bound by the award.
The magistrate found for defendant, allowing costs amounting to £4 17/-. ,
