HI,ATM AGAINST RANK. PLAINT! EP FAILS. HIS HONOUR ’S REGRET. (Per Press Association.—Cony right.) WELLINGTON, This Day. Reserved decision was delivered today by -Mr Justice MacGregor in the case of W. D. Lysuar v. the National Bank of New Zealand. Judgment was given for the bank. His Honour commented on the fact that the writ was not issued until May 13 of this. year, and said in his opinion it was a matter of extreme regret that it was ever issued. Any confusion or misunderstanding thal arose was largely due to plaintiffs conduct iit assuming to act as intermediary, while giving full eon lideuee to neither of the parties with whom he was dealing, and thus, to some extent, deceiving both. Plaintiff, in llis Honour’s opinion, failed to prove that defendant entered info Ihe contract alleged, either nil May 1, 1931, or any other date. llis Honour said he could nut help feeling - sympathy fur Hie plaintiff in his financial misfortunes, but these appeared in the present case to have influe need his better judgment ami led him to adopt a iiligous course, foredoomed to failure.
