A case involving an interesting point law came before Mr G. Cruiekshank, S.M., at Bluff. A two-gallon jar of beer was filled in a hotel on a Saturday before 0 p.m. and placed in a recess in the hall, the purchaser’s intention being to call for it later. The proprietor discovered.the jar and replaced it for safety in a private bar, and handed it over to the purchaser on the Sunday.
Tho point the magistrate was called on to decide was whether tho sale of liquor was actually completed when the purchaser removed the jar from tho bar in the first instance. The magistrate held that legally the whole transaction was finished on Saturday evening, and that delivery was complete, and on that ground the charge against the licensee of selling liquor after hours must be dismissed.
