A CONFLICT OF STORIES,

Alleging that lie had lent Harry Jones the sum of £2 10/ about three years ago. J. Smith sought to recover the amount at the Whangarei Magistrate's Court this morning. The plaintiff's story was that he lent Jones the money and subsequently met him in Auckland and asked him fpr the amount owing. Plaintiff said that he would not let him go until he paid up whereat, the defendant took him to a building and, telling plaintiff to wait, got out into the street-by another c(o.or. Smith' met Jones agam in. Auckland, and on another'demand for his money defendant paid him £1. He gave no receipt for this nor had he a receipt for the money lent. , , , In answer to the Magistrate Mr it. W. Tate, S. M. Smith said he was not «i money lender. The defendant .declared that he never borrowed the money from the plaintiff and never gave him the £1 on acount. 'The reason he took Smith into the building was because he, Jones, coullid not get rid of the other and that was the only way to do so. Defendant declared that plaintiff was i( dreaming" in regard to having lent the money.

His Worship, in non-suiting the plaintiff, said that when he lent money he must get an 1,0. U. Plaintiff said that he would see that he did get one next time.
