OVERBOARD AT ONERAHI.

CLAIM FOR DAMAGE'S.

An Auckland legal firm wrote to the j Whangarei Harbour Board meeting yes- j terdav stating that they had been con- j suited by Mir, Annie Dawes, of Omnnn, j regarding the responsibility of ' the j Board for an accident sustained by her on May 111 at Onerahi wharf, Avlien : about to board the Manara. It was a j dark night when the train stopped at | the wharf on that occasion and Mrs] Dawes started to walk beside the train to the steanler. It appeared that the wharf was unlighted, and was so narrow as tQ be very dangerous —practically a trap for passengers who alighted from the train. The result was that the lady fell into the water, from which she was rescued with difficulty. She suffered very severe shock, and had she I not been a strong woman the consej quinces would have been serious. She | was in bed for over a week, part of the | time spitting blood, and she wits dej lirious and suffered from loss of blood. ! She had been advised to take three j months' rest to overcome the effects of j the shock. Her purse, false teeth and | other property were lost, while the ' clothes she had on and the contents of

( a hamper she was carrying at the time [were ruined. The actual monetary loss ; wis £54 19s. A formal claim was made | for that amount and £50 ..as compensciI tion by way of general damages. I The" seeretarv, Mr .T. McJvinnon,

stated that upon receipt of the notification lie lia<l forwarded it to Messrs C«rrutli and Son for an opinion. The reply was that, as the wharf was entirely a Government construction and was not under the control of the Board, there was no liability upon the Board. Mr D. W. -Tuck moved that the Board's solicitor be asked to reply to the Auckland firm in accordance with the opinion received from the Board's solicitors, and the motion was carried.
