A FARM DEAL
LEADS TO LITIGATION

Before Mr. Justice Coopef, a case has opened In the Supreme Court in which Cecil Joseph Swan (Mr. J. R. Reed), a Dannevirk e farmer, applied for an order on Alfred Faithfull, junior, and the Public Truste 6 ' (Mr. R. McVeagh). to execute a conveyance to him of th e property. In the alternative £2000 damages were claimed, A counter-claim was made for £343 10s. damages, alleged to have been sustained by reason of non-compliance by plaintiff with the terms of th c agreement.
Mr. Reed said the purchase price of the farm was' £7000, and the plaintiff paid £250, as deposit. Owing to his receiving an njury he was unable to do any business for some time, and the period in which he was fco,, pay a further £750 lapsed before he recovered. . Ultimately, with a ! view to settling the matter it was arranged without prejudice that if the plaintiff could got the Land Board to advance all th fi cash * n e defendant would sell at £6 ,7s 6d an acre T'r> dirl not materialise, because of the cessation of 'Government assistance to discharged soldiers. Counsel maintained that one of the things that had influenced the defendant in refusing to complete the deal was the fact that the farm was now worth £2000 more than he had agreed to accept from the plaintiff.'
Evidence was given on th e lines of counsel's statements and the case stands -adjourned.
