NATIVE BOARDS MOVING TRAIN

WITH INOPERATIVE MILITARY

PASS

Before Mr F. H. Levien, S.M., yesterday, J. Thompson was charged on the information of the police with boarding a train in motion and also with endeavouring to travel upon the said train without a ticket.

The accused did not appear, and Sen.-Sergt. Cassells said the facts of the case were that the accused, who was a native resident of Motatau, attemped to board the train at Whangarei. He was stopped by a porter, but ran'trfter the train and climbed on the van. When asked for his ticket he could not produce one, but showed that he had a military pass available from July sth, but the offence was committed on July 2nd.

Guard Murray said that he first found accused on the train near Mairtown and discovered he had no ticket. He knew the man and intended to let him travel and collect later, but at Kamo he received instructions from the statioirmaster at Whangarei to put the man off. This he did, but the man climbed on aga'n, so he applied the Wcstinghousc brake and put him off again.

Sergt. Cassclls said the man was a Maori soldier with a pass, and he might have been a bit muddled about his right to use it. He did ;iot press for a heavy penalty.

His Worship agreed to convict the accused and lined him the amount of costs, £1 18s 3d, and Gd fare and fid line.
