Order for Possession
UNUSUAL CASE IN WAIPUKURAU From Our Own Correspondent. WAIPUKURAU, March 19. -nn unusual case was heard in the Waipukurau Court to-day when ABlom sought an order lor possession of a house in Gainsford Terrace owned by him, but which had been rented by H. Eden, who had vacated the house about five months ago, leaving a family called Brown in possession. It appears that Eden allowed tho Brown family to share the house with him when lie was renting it, but that subsequently ho left tho house but did not take the Brown family with him.
D. W. Neild gavo evidence as to the steps he had taken on behalf of Blom to regain possession of tho house. Brown, in evidence, said that Blom had told him he could stay in the house until he could find another, - provided ho paid the rent on behalf of Eden. Blom claimed that he had consistently • refused to accept Brown as a tenant, and that all rent' paid to him had been received on behalf of Eden.
Th© Magistrate held that Eden was the tenant and that as ho had vacated the ' house and obtained another the onus was on him to give the owner vacant possession of the 1 property. Ail order was mad© for possession in three week®.
