Allowing for What Might Have Been

MOTORIST WHO BROKE INTERSECTION SPEED LIMIT. Possibilities as opposed to facts entered into a case under the motor regulations brou'ght into the Pnlmorstou North Magistrate’s Court yesterday, when two motorists appeared to answer charges of driving at speeds which, in the circumstances, might have been dangerous to the public. The first defendant was H. E. Edmunds, of Palmerston North, who pleaded not guilty. Mr H. It. Cooper, who appeared for tho City Council, said the prosecution concerned tho regulation speed of 15 miles per hour over intcrescctions. Mr Edmunds said he might have been travelling at 30 m.p.b., but tho road was absolutely clear of traffic at the time, nor was there any traffic on the intersecting road. Under the circumstances, he didn’t feel inclined to admit dangerous driving. The Magistrate (Mr J. L. Stout) directed defendant’s attention to the wording of the section which said “might” have been dangerous. Mr Edmunds: Then I must plead guilty. , Mr Cooper: Defendant, is only one of dozens, or perhaps scores, who do the samo thing. Traffic Inspector Manley said he had estimated defendant’s speed over the intersection at 35 m.p.fo. He didn’t slow down. The Magistrate: There are a lot who cross intersections at 45 ni.p.h, A fine of £1 with 3s costs was imposed. The secoud defendant, G. T. liapley, was fined a similar amount.
