The fairness of the prccetiuro that governs the laws of evidence in British Courts was exemplified in the Police Court at Dunedin yesterday morning when three men woro charged with fighting outside an hotel. The police intimated that they had no evidence to offer as to actual assault, but proposed to call one man to givo evidence about the others. When this witness was called, the Magistrate (Mr. H. W. Bundle) said to him: “I repeat that you are not bound to give evideuce, aud I advise you to refuse.” Witness refused,mid all tho charges were dismissed. At Ashburton yesterday David Fitzgerald was lined £SU for using a billiard saloon as a common gaming house. The police said that defendant carried out extensive bookmaking in small amounts. He had £3!) in his possession when he was arrested. The case was a sequel to a raid by the police last Saturday.
