The condition of Messrs Monk and Pilcher and Miss Tylie, who wero all injured in a recent motor crash, is reported by the Hospital authorities as being satisfactory. Mr. F. C. Elgar, a well-known citizen of Palmerston North, was yesterday admitted to tho Palmerston North Hospital suffering from severe head injuries. His condition is serious.
Owing to rough seas at Manawatu Heads caused by prevailing westerly winds, tho m.v. Hutnui and in.v. Foxton were barbound at Foxton yesterday. Both vessels arrived in port about 5 a.m. on Wednesday, the Huanul with coal from Greyniouth and the Foxton with produce from. Lyttelton. A 12-year-old schoolboy, Brian Newton O’Connor, tho son of Mr. C. O’Connor, of Nelson, received a blow on the head while playing with other boys prior to entering a Technical School class on Wednesday afternoon. He appeared to bo suffering and went home. He was later removed to hospital, dying an hour after admission.
Judgment was given at Wellington yesterday in the Supremo Court by Mr. Justice Ostler that the Official Assignee failed to make out his title to the chattels of a bankrupt, Walter C. Franks, draper, of Fcatherston, seized by Mrs. Herbert under a bill of sale. Costs, £6 (is, were ordered to be paid out of the estate. Franks bought the drapery business from Mrs. Herbert, giving a bill of sale over the stock and entitling her to seize tho goods upon default. She did this on April 20 and carried on the business. His Honour said it would be noted that Mrs. Herbert was not entitled to the ownership of the goods. By the terms of the contract she held them for sale and disposal for tho purpose of obtaining the amount due. If by any chance the chattels realised more than the debt, sho would havo to account for tho balance to the Official Assignoe. She being in the position of mortgagee in possession, it behoved her, therefore, to keep strict accounts of the disposal of all goods seized,
