IS a CHEQUE LEGAL TENDER? OTAKI MAYORAL ELECTION PETITION ADJOURNED OTAKI, Juno 21. An unexpected turn was taken by the Magisterial enquiry which opened in the Otaki Courthouse this morning into the Otaki Borough Mayoral election. The petition was presented by Mr C. F. Atmorc, who waft defeated by six votes, and who made allegations of certain irregularities in the conduct of the election. Counsel for Mr O’Rourke, who was declared elected after a Magisterial recount, submitted that the cheque for £lO wMcli accompanied Mr Atmorc’s deposit of the peti- ! tion for the enquiry did not coni stitute legal tender, and that this ! Electoral Court v/as therefore without jurisdiction to proceed with i tho enquiry. ! After hearing couusol on both eides in argument which lasted for hours, Mr j. L. Stout, S.M., adjourned the case sine die as he wished to consult j further authorities than those quoted.
