FAILS TO SECURE RETURN OF £IOOO
BOOTMAKER—BOOKMAKER. UNLAWFUL AGREEMENT, HOLDS . , JUDGE. Per Press Association. WELLINGTON, Last Night. Judgment in tho caso which opened in the Supreme Court on Wednesday before Mr. Justice MacGregor, in which Richard Cox on, bootmaker, of Wellington, proceeded against Laura Louise Coxon, hi 3 wife, for £IOOO, or for an order declaring that the money was his property, was given in favour of defendant. “I am satisfied,” said tho Judgej “this Court should not interfere and should not assist the plaintiff in carrying out an unlawful agreement. It is equally clear it is open to tho defendant- to set up tho unlawful agreement as a: defence. Indeed, if it is'not contepded it is the duty of tho Court to set up the defence.” Costs wero given to defendant on the lowest scale. . ■ The sum was given, stated tho Judge, by plaintiff to his wife in order to conceal the amount lie was making at bookmaking.
