MAGISTRATE’S COURT
MOTOR CAR COLLISION. CLAIM AND COUNTER CLAIM. A collision between two motor cars on the Colyton-Taonui road on December 10. last, resulted in a civil action boiug heard at the Peikling Magistrate's rourt on "Wednesday before Air. E. M. Watson, S.AI. George. P. Burr, farmer, of Oolykm, sued John Williamson, also a farmer of Oolyton for £4S 9s. Plaintiff set out that, on the date in question he was driving towards Taonui when defendant suddenly drove bis car out of a gateway concealed in a macrocarpn lirdge, across the ruad in front, of plaintiff's car. Every endeavour was made to avoid a collision without, result. Plaintiff's car sustained damage lo the amount of £2B 9s and ho alleged that tho car suffered depreciation to the extent of £2O. The defendant counter-claimed foi £9O os, alleging negligence on the part of plaintiff in driving at a grossly excessive speed on tho wrong side of the road. As a result of the accident defendant received severe personal injuries and his car was, lie, alleged, seriously damaged and suffered depreciation. .He therefore counter-claimed to recover £ls 5s repairs to car, £5 loss of use of car. £2O depreciation ami £SO personal injuries and general, damages. After hearing lengthy evidence decision was reserved. At the hearing Air. Smith of Pahiatua appeared for tho plaintiff and Air. Cooper of Palmerston North for the dofendant.
