FARMERS AT LAW OVER HAY AND MANGEL CROP
DECISION RESERVED. Hay and mangels valued at £3O formed the subject of a claim by E. E. Saunders, farmer, .of Newbury, against J. P. Tierney, farmer. Of Taihape, in the Magistrate’s Court yesterday. ■ Plaintiff, counselled by Mr. H. G. Fletcher, alleged that defendant, who was sharomilking for him at Glen Oroua, isold hay and mangels off the farm to one TV J. Walsh for £6O. Plaintiff considered that under agreement, he was entitled to half-sharo of all sales off the farm, Counsel for defendant, (Mr. A. M. Ongley) contended that the claim must have been brought under a misapprehension as the . agreement only gave plaintiff- half-share , in, the pigs and products, from ' the. cows and nothing else. Defendant was entitled by the agreement to grow sufficient hay and roots to feed,his .covsrs and so could have removed tho hay and mangels off tho place,completely had he wished. As it happened, Tierney had sold the fodder to Walsh who succeeded him on the farm and plaintiff was getting the benefit of same in increased butterfat returns. His Worship reserved decision.
