MAGISTRATE’S COURT

FORTNIGHTLY SITTING. The fortnightly sitting of the FeildIng Magistrate’s Court was held yesterday before Mr. J. L. Stout, S.M. Judgment by Default. Judgment was given plaintiff by de. fault in the following undefended civil actions; James Porter (Mr. Mclntyre) v. W. Powell, £53 7s, costs £4 18s 6d: J. S. Edelston (Mr. Elliott) v. W. H. Hunt, costs only 15s. Wandering Stock. Henry J. Dixon, farmer, of Bunnythorpe, for allowing a Jersey bull to wander at large along the roads of the Oroua County, was convicted and fined £3. Sheep With Lice. For exposing sheep affected with lice for sale, T. A. Pitt, of Kopane, -was convicted and fined £3 and costs 13s, and J. H. Pratt, of Hamilton, was convicted and fined £3 and costs 12s. Failed to Attend Camp, Staff-Sergeant Major Byan, proceeded against W. Hefferman, of Feeding, on a charge of failing to render the service required of him under the Defence Act. Accused had a previous conviction and had failed to attend the January camp at Wanganui. Mr. D. C. Cullinane appeared for accused. In view of the previous conviction, the Magistrate said he could not consider the imposition, of a nominal fine. Accused would be convicted and fined £5 and costs. Kimbolton Road Crossing Accident. The police, represented by Constable McCall, proceeded against J. J. Gatcnby, farmer, of Hastings, on a charge that on the morning of March SO last he did pass across the Kimbolton Boad crossing without exercising due vigilance of approaching trains. Mr. Graham appeared for accused and pleaded guilty. Counsel said that his client was a stranger to the town and was not aware of the danger at the crossing. Accused was convicted and fined £2 costs 10s being allowed. Thomas Miller was fined £2 and costs for failing to keep a vigilant look-out for approaching trains when crossing the line in Kimbolton Boad. Unlawfully converting to his own use a motor-cycle the property of Robert Cross, cost Archibald Zwcibruck, of Halcombe, £lO and costs. John W. Ireland, of Feiiding, was charged with driving a motor vehicle without being the holder of a driver’s license. The action arose as a result of a collision wdth a gig in Kimbolton Road on May 5. Mr. Mason appeared for accused and pleaded guilty, explaining that the accident occurred While his client was gaining proficiency in driving before applying for a license. A conviction was entered and a fine of £1 and costs imposed.
