LAW OF MOSES IN DIVORCE
Strange reasons, even for an American divorce court, wore given by Jacob Freizner in petitioning before Judge Lydon, in New York, for the nullity of his marriage with his wife Caroline.
Freizner is 00 years old, and his wife .10 years his junior. Both are Jews. The petitioner alleged that the respondent, when a widow, became his wife by fraud. She had represented to him* falsely, he said, that she had complied with the Biblical law laid down in Deuteronomy, chapter 25, which provides that when a husband dies the widow is to go to his brother, and makes a demand that he marry her.
Should he refuse, she must follow the procedure in verse 9: — < ‘ Then shall she come unto him in the presence of the elders and loose his shoe from off his foot, and spit in his face.”
Jacob Freizner alleged that his wife did not loose her brother-in-law's shoe, nor did she spit in his face. The Judge ruled that these reasons were too much for him to decide, and ordered the ease to be tried by jury.
