RESIDENT MAGISTRATE'S COURT.
PALMEBSTON NOBTH. Wednesday, Oct 31st. (Before His Worship the Mayor, J.P., and J. T. Dalryinplo Esq., J.P.) John Francis* was brought before tbeir-Worships to answer to a charge of larceny, preferred against him by Mr J. E. Gilbert of the Royal Hotel, Palmer ston North. , John E. Gilbert being sworn said: I am an hotelkeeper residing at Pal-merston-North. About tho month of June 1876, I missed from my stable yard, a disused kitchener, and an iron stove plate. I received information last Saturday week, the 20th October, that portions of the plate were m Messrs Woolcock and Hoskings' shop. Woolcock andHoskings, informed me that the iron had been left by John Francis. I recognise portions of the plate as c-Jieing my property. lvalue the plate ab?«ips. , .Yesterday, October 30th, I wefi^aectuHpanied by • the Constable to Franois' house and there found on the ' premisesanlime'rican kitchener portions - of which f»re now v .inlpourt- I recognise , it as my property.. Francis hasrepeatedly asked* me, to sell him thisaron, but J . have invariably refused to have~any transaction, with him whatever. Jpharles Hoskings sworn said : lam < a/Triacksmifch residing at Pahnerston North. I am a partner m the firm of Woolcock and Hoskings. ,Some time > ago we required a piece of plate for a 1 job we had m hand, and John Francis offered to supply us on condition we •would cut him out two plates he wanted, and we could have the remainder of the' iron for our job. The two plates now produced we, made for Francis. My paztner Woolcock went to Francis' house .for the iron. I recognise the piece now produced as being the same 'that he Drought.' It 'might weigh from 20lb. tomb. ' ■-«' ) John- Gillespie sworn said : I am district Constable stationed at Palmerston North. I went to the house of the accompanied' by the informant with a search warrant. I went to search for the remains of a stove, and found it , there. The portion of the , stove now produced is the one I found. It was lying alongside the house within the fence. ' ' - , The prisoner upon being asked what' he had to say m answer to the charge, applied to have the case adjourned, that he might have the benefit ofCounsel. rAn adjournment was therefore granted until Thursday week, November Bth, bail 'to be accepted, himself m £100 and two sureties of £50 each.
