APPEAL FROM AWARD. WELLINGTON. Sept. 26.

The Court of Appeal this week, comprising Mr Justice Blair, Mr Justice Kennedy, and Mr Justice Northcroft, heard an appeal by G. A. Mclntosh, of Tiptipakuku. sawmillcr, ngfiinst- the whole of a judgment by Mr Justice Smith delivered at Palmerston North oil June 26 last, in which His Honour, following a verdict by a jury of 12, awarded Mrs D. M. v. Metcalfe, of Norsewood, £2571 4 s general damages and £23 special damages, as compensation for the death of her husband. J. W. Metcalfe, who died on October , 1941, from injuries received vrhilo operating a winch log-hatilelr, the property of Mclntosh. Mr G. T. McGregor (Palmerston North), with him Mr T. H. G. Libya (Dalinevirke). appeared for appellant, and Mr 11. W. Dowling for respondent. Mrs Metcalfe. After hearing legal argument, which extended over two and a half days, the Court reserved its decision.
