CABIN BOY’S CRIME.
MURDER OF BRITISH CAPTAIN. DISMISSAL OF APPEAL. LONDON, Dec. 8. •* An appeal on behalf of a penniless Chinese cabin boy against a death sentence has been dismissed by the Privy Council. Almost two years ago, Chung Chichueng, aged 23, shot and killed the British master of a Chinese Customs cruiser, Captain Douglas Lorne-Camp-belL ■ _ . ■>' . The cruiser was in the territorial waters of the British colony of Hong Kong. Sentence of death passed by the Supreme Court of Hong Kong was upheld on appeal by the Full Court of Hong Kong. ' The appeal to the Privy Council was based upon the contention that the crew -of the cruiser, as a public* armed vessel of a visiting State, was immune from the jurisdiction of the Hong Kong Courts. Dismissing the appeal, Lord Atkin said that, so far as English Courts are concerned, international law is not valid except in so far as its principles arc accepted and adopted by domestic law.
The Court unhesitatingly rejected the doctrine of extraterritoriality, which regarded a public ship as “a floating portion of the flag of State.”
