MAGISTRATE’S COURT.
BY-LAW CASES. Mr H. P. Lawry,.S.M., presided over the sitting of the Magistrate’s Court at Palmerston North yesterday. Charged with-driving through Longburn at a speed which might have been dangerous to the public, J. T. Allen was fined £3, with 10s costs. Traffic Inspector H. J. Semple stated that he had- chased defendant for three mnes. Defendant's speed increased rrorn 43 to 60 miles per hour after reaching the straight stretch of road outside Longburn. Visibility was bad the time was 10.10 p.m., and the locality was notorious for unlighted cycles at night. A penalty of £2, with 10s costs was imposed on C. W. Bovd ior driving at a speed exceeding 30 miles an hour through Sanson, a locality restricted as a closely populated area. Traffio Inspector Simple said it was the day of the Marton races, and defendant had crossed an intersection in tho township at 40 miles an hour. For driving at 45 miles an hour through Sanson. R. A. Williams was fined £3, with 10s costs.
For failing to carry an inspection certificate on one of their vehicles ns required by the regulations. Child Bros, were fined 10s, and 10s costs, ana a similar penalty was imposed on A. Hancock for driving the lorry without carrying .a warrant of fitness. Mr G. Tremaine, who appeared for defendants, said the lorries were kept in perfect condition, and the obtaining of the certificate had been overlooked. Stated to have had no heavy traffic license for the current period, his old one having expired, A. E. Adams was fined £1 10s for carrying a lorry-load of 3 tons 19 cwt. 1 qr. without a heavy traffic license. For failing to carry a warrant of fitness for a car, N. Needham was fined 10s. with 10s costs.
Commenting that the vehicle had been 50 per cent, overloaded, the Magistrate inflicted a fine of 30s, with 12s costs, on H. AV. Jensen for permitting a lorry to carry a load in excess of that for which it was licensed. Tt was ■ stated that the lorry, licensed for 5 tons, was carrying a load of battens weighing 7 tons 7 cwt. 1 qr. Mr A. AA 7 . Yortt, appearing for defendant, stated that the lorry had been loaded and driven by his employees, though he was responsible, and a heavy traffic license had now been taken out for two classes higher.
A. E. Rutledge was fined £2. with 12s costs, for driving in a dangerous manner on the Feilding-AwahurL Read. Traffic Inspector Semple stated that defendant, driving at 40 miles an hour, had gone round two corners very close to the right-hand bank on a roadway 15 feet wide. AVitness had sounded liis siren for half a mile until he had pulled alongside defendant and signalled him to stop. F. Teiffel was fined £2, with 10s costs, for riding a motor cycle in a manner which might have been dangerous to the public, at Martpn. Mr Semple said that defendant, who had only taken delivery of the machine that morning, rode at 45 miles an hour, and passed two vehicles on an intersection.
A. MacAVoodman was fined £2, with 10s costs, for riding a motor cycle on Milson’s Line in a manner-which might have been dangerous to the public; and £l, with 10s costs, for not having an effective silencer on the machine.
Regarding it as a technical breach, the Magistrate fined Andrew R. Buchanan (for whom Mr P. E. Baldwin appeared) 10s. with 16s costs, for failure to give way to traffic approaching from the right at the intersection of Fcatherston and Heretaunga Streets.
