CLAIM FOR DAMAGES.
GIRL WHO WALKED ON SICKLE. , Per Press Association. CHRISTCHURCH, Oct. 19. A girl who was injured in walking on a sickle lying on the side of a road outside a residence at Hanmer Springs last January succeeded in an action for damages in the Magistrate’s Court against the owner of the sickle. The Magistrate, Mr H. A. Young, attributed negligence on the part of the defendant, and awarded damages amounting to £ll2 4s. The action was brought by Joy Wooler against Hedley James Peek for £IOO general damages and £64 2s special damages. It was claimed that Peek had negligently left a sickle in a public road. The girl had walked down the road to join her parents, and had stepped on the sickle, which twisted, cutting a tendon in her leg. An operation had been necessary. The case for the defence was that there had been contributory negligence. "I am satisfied that there was no want of care on the part of the plaintiff,” said the Magistrate.
