CLAIM FOR DAMAGES.
MOTOR-CARS COLLIDE. Arising out of a collision between a motor-car and a service ear on the Palmerston North-Ashhurst Road, on June 10, a claim for £l7 special damages and £3O general damages was made m the Magistrate’s Court, today, by Mrs Editn McKinley, of Aokautere, against Newman Bros. (North Island) Ltd. A counter-claim for £lO 12s was made by defendant company. Mr J. A. Grant appeared for plaintiff and Mr M. H. Oram for defendants. Mr J., L. Stout, S.M., was on the Bench. Mr Grant stated that, about 7 p.m. on June 10, Angus McKinley, husband of plaintiff, was driving his wife’s car to Palmerston North from Ashhurst and met the service car, which was going in the opposite direction, at Speedy’s Hill, where the collision took place. He alleged excessive speed and unskilful driving against the service car driver.
Plaintiff, in her statement of claim, attributed the accident to excessive speed, failure to keep a proper lookout, failure to keep proper control of file car and failure to keep to the correct side of the road. Similar complaints were made by the defendant company against the driver of the car, Angus McKinley. Several passengers in both vehicles gave evidence, part of which was taken in Napier. The case is proceeding.
