RESERVED JUDGMENT.
BUTCHER’S CLAIM. Reserved judgment, in favour of plaintiff, was delivered-in the Alagistrate’s Court, yesterday, by All" J. L. Stout, S.M., in the case in which E. T. Burke proceeded against A. G. Parland, claiming £26 7s 7d as the balance of wages allegedly due. Air T. F. Belling appeared for plaintiff and Air A. Al. Ungley for defendant. The judgment stated that His Worship had come to the conclusion that tlie actual amount paid, and intended to be paid, b.y the employer, was £3, as was arranged when defendant employed plaintiff. “In these circumstances 1 am of tlie opinion that plaintiff is entitled to recover, for the six months limited by Statute, the difference between £3 and the award wage of £4 6s for a general hand. I do not think that the evidence sufficiently establishes that the worker was a small goods hand, though he did a certain amount of this work. I allow no credit for meat supplied. The evidence is that custom this is free, and in any event would be a breach of the Act. Judgment will be for weeks’ pay at £L 6s, a total of £l7 11s, and costs, £4 125.”
Judgment was entered on the lines indicated.
