HEWER CASE

BAIL REFUSED. Per Press Association. AUCKLAND, Sept. 11. Applications to the Supreme Court for bail for George Frederick Hewer, who was committed for trial on a charge of unlawfully using an instrument on a female, and also with causing her to take a noxious thing, were refused in the judgment of Mr Justice Fair given to-day.

His Honour declined to depart from the English authority of 1854, and the subsequent authority of Mr Justice Stout in 1903, which laid down three rules for consideration in determining whether a party will appear for trial. These must lie answered adversely to the accused, held Mr Justice Fair. No exceptional circumstances had been adduced, Mr Justice Fair said.

Mr Justice Smith agreed with the judgment.
