CASES FOR APPEAL. Per Press Association. WELLINGTON, June 25. The Full Court is occupied to-day in hearing two cases of considerable importance to goods service proprietors. The first is an appeal from the decision of Mr J. H. Salmon, S.M. at Wanganui, whereby he convicted Archie Frederick Wilson of carrying on a goods service between Wangaehu and Wanganui otherwise than pursuant to the authority of a goods service license granted under the Transport Licensing Act, 1931, and contrary to section 20 (1) of the Transport ' (Goods) Order, 1933-34, and section 47 of the Transport Licensing Act, 1931. The second case, Maurice Ordish Fairhurst against- Robins and Coy., from Dunedin, deals with similar facts.
In view of their importance both cases were remitted to be heard by the Full Court. By arrangement the two cases, which are brought to test the legality of the Transport (Goods) Order, 1933-34, are being heard together. Mr Dickson, appearing for appellants in the first case, opened. Mr Baylee is appearing for Robins and Coy., and Mr Currie, with him Air Bain, is appearing for Fairhurst. Air Dickson concluded his argument for appellant in the first case after the luncheon adjournment and Air Baylee commenced liis argument for respondent in the second case (Robins and Co.). He intimated that the Alagistrate at Dunedin, in dismissing the information against Robins and Co. for carrying on a goods service without a goods sendee license, had held that the provisions of the Transport (Goods) Order, 1933-34, were ultra vires, and he proceeded to cite his legal argument. Before Air Baylee had concluded the Court adjourned till tomorrow morning.
