MAGISTRATE’S COURT

BY-LAW CASES. Mr J. L. Stout' S.M., presided over yesterday’s sitting of the Magistrate’s Court, when by-law cases, etc., were dealt with.

Walter Anderson, farmer, of Rangitane, was charged that, on March 2, at Rangitane, while in a state of intoxication, he was in charge of a motor truck on the Palmerston North-Foxton main road. A plea of not guilty was entered and on the application of Sergeant Calloty accused was remanded till Monday next. On the application of Mr G. Kells bail of £2O and. one surety of £2O was allowed. Edward Kelly, alias Patrick Kelly, a labourer, was charged that, on March 3, a.t Palmerston North, he was deemed to be a.n idle disorderly person in that ho had insufficient means of support. Accused pleaded guilty and was sentenced to one month’s imprisonment with'hard labour. Michael William Stack, alias Michael Slack, a labourer, was charged with being an incorrigible rogue in that he had been previously convicted as an incorrigible rogue. A plea of guilty was entered and sentence of two months imprisonment was imposed. P. Townshend was charged with parking his car over a fire plug. I)e----iendant explained that the occurrence took place on the night of the storm on February 9 when he had been misled by the cycle stand having been washed away. .Defendant it ns convicted and ordered to pay costs 3s (only). . . For being on licensed premises when such premises were required to he closed, J. H. O’Neil was fined £2 and costs 10s. For riding tlieir cycles at night without having lights affixed, J. Kiripna and W. F. Watson were each fined 10s, with costs 10s. For driving a motor vehicle without being the possessor of a motor driver’s license, Duncan Mcßae was fined 5s and costs 10s.

Arising out of an accident wherein the previous defendant was involved. J. F. D. Hewitt was charged that he had failed to give way to traffic from the right. Mr L. M. Abraham, who appeared for defendant, entered a plea of guilty, stating that it had been raining 'at the time and defendant’s vision had been obscured. Sergeant Culloty further explained that although it was raining the sun was shining at the time. However, it was quite possible that the sun would he in defendant’s eyes as he was proceeding along Church Street towards the Square A fine of £l, and costs 12s, was imposed. G. W. Cameron, who was jri arrears to the extent of £o 16s 3d on a maintenance order in favour of his two children and a like amount in respect of his wife, was. sentenced to a month's imprisonment, defendant to be released on payment of the arrears. John R. Taylor, was sentenced to a month’s imprisonment, defendant to be released on payment of £3 17s 6d. arrears due on an order iii favour of his wife and two children.
