PLEA TO JURY. FLEMINGTON, Feb. 11. In the trial of Bernard Hauptmann on a charge of murdering the Lindbergh baby, after the assistant prosecuting attorney. Mr Hauck, had given an hour’s routine summation of the case, to be followed to-morroiv by the filial State’s plea, delivered by Mr Wilentz, the defence attorney, Mr Reilly, presented a lengthy summation to the jury through which lie hopes to gain tlie acquittal of Hauptmann. in a powerful forensic effort which at times obviously moved some members of the jury, Mr Reilly asked the jury not to consider any evidence tending to indicate that Hauptmann was an extortionist, but to concentrate on the salient fact, namely, did Hauptmann climb the ladder, enter the Lindbergh nursery, remove the child, accidentally kill it When the ladder broke, and bury tho body in a slialloiv grave P In starting his speech, Mr Reilly quoted from St. Matthew. “Judge not lest ye may be judged.” Ho asked: “Who knew tho baby had a cold and had to stay at Hopewell that Monday nightP” He answered his own question with the words: “Not Hauptmann. Nobody in God’s world but Lindbergh, his lovely wife, Ills butler, his butler’s wife, Betty Gow, servants in the Morrow home, and ‘Red’ Johnson.” Counsel added that Colonel Lindbergh might trust them, but he did not. He declared it inevitable that one of them must have removed the baby and placed the ladder as a “plant.” Otherwise why did not the baby cry or the dog bark ?
