SUPREME COURT.

unusual development. Per Press Association. HAMILTON, Nov. 22. There was an extraordinary development in a case in the Supreme Court at Hamilton to-day in which Henry T. Scott, aged 28, was charged with breaking and entering a dwelling at Oaudelands and stealing a violin and a case of jewellery valued at £3l. Mr J. F. Strang, for accused, in opening, said that a man now serving a sentence in Mount Eden gaol, and who was sentenced at Auckland this week, would come forward and say that he entered the house at Claudelands and stole a violin and jewellery which he sold to a dealer for 18s.

Counsel added that the defence relied substantially on the alibi. His Honour adjourned the case to permit of the prisoner being brought from Auckland to give evidence. Later, after hearing the evidence of Frederick Owen Tuurch, who is serving a sentence, at Mt. Eden, the jury discharged Scott. Tuurch admitted the offences

Colin Yeatman, aged 21, and Frederick Harvey McGregor, aged 47, were sentenced for breaking and entering and theft at Tokoroa. Yeatman was admitted to probation for two years, and McGregor was sentenced to one year’s hard labour.

Robert Bamberry, 55 years of age, former sanitary and traffic inspector for Tauranga borough, was admitted to probation for two years on five charges of theft involving £37, mostly license fees. He was ordered to malic restitution.
