CRICKET BALL BREAKS WINDOW

Per Press Association,

WELLINGTON, Nov. 20. A plate glass window which was smashed by a cricket ball hit out of Anderson Park cricket ground last December was the subject of a Magistrate’s Court casq in which Mrs Francis Lamerton Andrews, sued in respect of her separate estate, and claimed £l6 8s 9d fVoin the Wellington City Counci*, owner of the reserve. It was stated that this was the second occasion on which the shopowner had to replace a window, though in the first instance she took no action.

For plaintiff it was alleged that the playing of cricket on a pitch too close to the side of the .park was a nuisance and a source of danger to adjoining properties. This was denied by the City Corporation, which declared that although the corporation had prepared three pitches on the ground, the Cricket Association or club teams had the matter in their own hands and the liability was theirs and not the council’s; further, that the council was empowered by Statute to lay out playing areas, and thtf€ compensation was provided if any person suffered as the result of the council exercising its satutory power, and that the proper remedy was by compensation.
