JURY FAILS TO AGREE
EKETAHUNA COLLISION CASE. After a retirement of four hours yesterday afternoon, the jury laded to agree in the case in which Henry Morris, a labourer, of Newman, near Eketahuna, brought a civil action, as the result of a motor accident, against Airs Katherine Annie Johnston, of Eketahuna, claiming £1541 18s damages. MrJustice Blair presided while Air H. It. Cooper appeared for plaintiff and Air Lawson, of Featherston, for defendant. After the jury had been in retirement for just over two hours, they were recalled by His Honour and given directions as to the provisions for giving a three-fourths verdict. After a further retirement of three- j quarters of an hour they returned again, asking that the position of contributory negligence be explained. His Honour accordingly dealt with the posi- !
tion and a few minutes later the jury were recalled, the foreman saying that there was no possibility of an agi cement. The jury was -then discharged. Mr Cooper formally asked lor a new trial it being explained, however, that it could net he held this session.
