DUNEDIN, Oct. 30,
“This case represents an attempt to secure a measure of justice for a British seaman who was injured in the employ of the Byrd Expedition and who was put ashore at Dunedin,” stated counsel for John Taylor Burt, who claimed in the Arbitration Court to-day compensation from Admiral Byrd for injuries allegedly received in an accident on the Jacob Ruppert and in a fall down a crevasse. , The defence was that the Jacob Ruppert was not a New Zealand ship and that plaintiff, if he suffered the accidents (which was denied), was not entitled to compensation under the Act. If was denied that the relation of master and servant existed, Burt being a joint venturer in the expedition and any payments being voluntary. The case is proceeding.
